Acceptance of Terms
By accessing or using any service offered by NordServ (“we”, “us”, “our”), including but not limited to virtual private servers, game servers, and managed hosting services, you (“Client”, “you”) agree to be fully bound by these Terms of Service (“Terms”).
If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity. If you do not have such authority, or if you do not agree with any part of these Terms, you must not use our services.
Services Provided
NordServ provides cloud infrastructure services including, but not limited to:
- Virtual Private Servers (VPS) with SSD and NVMe storage options, including a self-service custom specification builder (1–16 cores, up to 128GB RAM, up to 1TB disk)
- Game server hosting (Minecraft, FiveM, and others)
- Managed WordPress hosting
- Email hosting
- Managed server services including monitoring, patching, and support
- Custom infrastructure solutions beyond the self-service builder's limits, arranged by agreement
All services are delivered from our datacenter in Montreal, Quebec, Canada. We welcome customers from Canada, the United States, and worldwide — our Montreal location offers strong latency for the US, especially the northeast, and solid performance globally. We reserve the right to modify, expand, or discontinue any service offering at any time with reasonable notice to affected clients.
Account Responsibilities
You are solely responsible for:
- Maintaining the confidentiality of your account credentials, SSH keys, and any access tokens
- All activity that occurs under your account, whether authorized by you or not
- Ensuring that all information provided to NordServ is accurate and kept up to date
- Promptly notifying us of any unauthorized use or suspected breach of your account
NordServ will not be liable for any loss or damage arising from your failure to maintain account security. You must be at least 18 years of age to create an account and use our services.
Acceptable Use Policy
Our services may only be used for lawful purposes and in accordance with these Terms. You agree not to use NordServ services to:
- Send unsolicited bulk email (spam), phishing messages, or engage in any form of email abuse
- Host, distribute, or transmit malware, ransomware, viruses, or any malicious software
- Launch, facilitate, or participate in distributed denial-of-service (DDoS) attacks against any target
- Mine cryptocurrency without prior written consent from NordServ
- Host or distribute child sexual abuse material (CSAM) or any illegal content under Canadian law
- Conduct port scanning, network probing, or penetration testing of systems you do not own
- Infringe upon the intellectual property rights of any third party
- Circumvent or attempt to circumvent any security measures we have in place
- Resell NordServ services without prior written authorization
- Operate IRC servers, IRC bots, or IRC clients of any kind on our infrastructure
Payment & Billing
All prices are listed and billed in Canadian dollars (CAD), regardless of your location. Services are available on monthly, 6-month, or annual billing cycles. Customers whose card or account is denominated in US dollars or euros are typically charged less in their home currency than the listed CAD amount, since CAD has historically traded below both; this exchange-rate benefit is not guaranteed and may vary over time.
- Payment is due at the start of each billing period. Failure to pay within 7 days of the due date may result in service suspension.
- We accept major credit cards via Stripe and PayPal, Interac e-Transfer, and cryptocurrency (Bitcoin via BTCPay Server; Ethereum and stablecoins via NOWPayments). For Interac e-Transfer and cryptocurrency payments, services are activated automatically once the payment is received/confirmed and matched to your order — this is typically within minutes for cryptocurrency, or minutes to a few hours for Interac e-Transfer, but may take longer.
- There are no setup fees on any standard plan.
- Services may be billed monthly, every 6 months, or annually. A 10% discount applies to 6-month prepayments and a 15% discount applies to annual prepayments.
- Prices are subject to change with 30 days’ written notice. Continued use after the effective date constitutes acceptance of the new pricing.
- cPanel/WHM can be installed on your VPS. A license will need to be purchased by you directly — we do not resell cPanel/WHM licenses.
Plan Changes
You may change your service plan at any time through the NordServ customer portal.
- Upgrades are charged a prorated amount for the remaining days of your current billing period based on the price difference between the old and new plan. For PayPal and Stripe, the upgrade takes effect as soon as that charge is confirmed. For Interac e-Transfer or cryptocurrency payments, you will receive payment instructions (a phrase and amount for Interac e-Transfer; a payment address/invoice for cryptocurrency), and the upgrade takes effect once that payment is received and confirmed — not immediately.
- Downgrades are scheduled to take effect at the start of your next billing period. No refund or credit is issued for the remaining time on the higher-priced plan.
- You must explicitly confirm the exact amount and plan terms before any billing change is processed. The portal will display the precise charge before you confirm.
- VPS plans may only be upgraded, not downgraded. Disk storage cannot be reduced on an existing virtual machine.
- WordPress plans may only be downgraded if your current disk usage fits within the quota of the lower plan.
- Pending downgrades may be cancelled before they take effect through the customer portal.
- VPS upgrades are applied automatically and include a brief server reboot to activate the new resources — you'll confirm you're okay with this quick reboot before the upgrade is processed.
VPS OS Reinstallation
You may reinstall the operating system on your VPS at any time through the customer portal, choosing from the OS options offered at checkout.
- Reinstallation is self-service and immediate. It permanently erases all data on the server, including files, databases, and configuration — this cannot be undone.
- You must explicitly confirm the action by typing your server's hostname before it is processed.
- NordServ is not responsible for any data lost through a self-service reinstallation. Back up any data you wish to keep before proceeding.
VPS Console Access & Power Controls
Every VPS plan includes a browser-based console and self-service power controls (Start, Stop, Reboot, Reset) in the customer portal, at no additional charge and without needing to open a support ticket.
- The web console provides direct screen access to your server, independent of its network configuration or SSH availability.
- Start, Shutdown, and Reboot request an orderly power state change from the operating system.
- Reset and Stop immediately cut power to the virtual machine, equivalent to unplugging a physical server. These actions may cause data loss or filesystem corruption and should only be used when your server is unresponsive to a graceful reboot or shutdown.
- NordServ is not responsible for data lost as a result of a self-service Reset or Stop action.
Plan Add-ons
WordPress and Email plans support optional add-ons to increase your plan's included storage or mailbox count, purchased self-service through the customer portal.
- WordPress plans may add extra disk storage for $1 CAD per GB per month, on top of the base plan's included quota.
- Email plans may add extra mailboxes for $1 CAD per mailbox per month, on top of the base plan's included mailbox count.
- Add-ons take effect immediately upon purchase. The additional recurring charge begins on your next billing cycle — no prorated charge is collected at the time of purchase.
- Add-ons may be reduced or removed at any time through the customer portal, reducing your recurring charge starting on your next billing cycle.
- Removing or reducing a WordPress storage add-on requires that your current disk usage fits within the resulting lower quota.
Service Level Agreement
NordServ targets a 99.9% monthly uptime on all VPS and game server plans, calculated as the percentage of time services are reachable and operational during a calendar month, excluding scheduled maintenance windows.
- Scheduled maintenance will be announced at least 24 hours in advance via status.nordserv.ca and does not count toward downtime calculations.
- Emergency maintenance required to address critical security threats or hardware failures may be performed with shorter notice.
- In the event of verified downtime exceeding the 99.9% SLA, eligible clients may request a proportional service credit for the affected period.
Suspension & Termination
NordServ reserves the right to suspend or terminate your service at any time for the following reasons:
- Violation of the Acceptable Use Policy (Section 4)
- Non-payment of invoices past the grace period
- Providing false or misleading information during registration
- Activity that poses a legal, security, or reputational risk to NordServ or its other clients
- Receipt of a valid court order or legal demand from Canadian authorities
You may cancel your service at any time by contacting us. Cancellations take effect at the end of the current billing period. Upon termination, all data stored on your service may be permanently deleted within 7 days. We strongly recommend maintaining your own off-site backups at all times.
Data & Privacy
NordServ is committed to protecting your personal information in accordance with Canada’s PIPEDA and Quebec’s Law 25 (Act respecting the protection of personal information in the private sector).
- All data is stored exclusively on servers physically located in Montreal, Quebec, Canada.
- We do not sell, rent, or share your personal information with third parties for marketing purposes.
- Payment data is processed by PayPal, Stripe, and our cryptocurrency payment processors (BTCPay Server, NOWPayments), and is never stored on NordServ infrastructure. For Interac e-Transfer, only the transfer notification (sender name, amount, reference number) is processed to match your payment.
- We may access client server data only when explicitly requested by the client for support purposes, or when required by a valid legal order.

Limitation of Liability
To the maximum extent permitted by applicable law, NordServ and its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of data, revenue, profits, or business opportunities
- Damage resulting from unauthorized access to your account or server
- Service interruptions beyond our reasonable control
- Actions taken by third parties using our infrastructure
In all cases, NordServ’s total liability to you for any claim shall not exceed the total amount paid by you to NordServ in the three (3) months preceding the event giving rise to the claim.
Intellectual Property
All content on nordserv.ca, including but not limited to the name “NordServ”, logo, website design, written content, and documentation, is the exclusive intellectual property of NordServ and is protected under applicable Canadian copyright and trademark law.
You are granted a limited, non-exclusive, non-transferable license to use our services solely for your own lawful purposes. Nothing in these Terms transfers any ownership or intellectual property rights to you.
Modifications to Terms
NordServ reserves the right to update or modify these Terms at any time. When we make material changes, we will update the Effective date at the top of this page and notify active clients via email at least 14 days before the changes take effect.
Your continued use of our services after the effective date of any updated Terms constitutes your acceptance of those changes. If you do not agree to the revised Terms, you must stop using our services before the effective date.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in the Province of Quebec. You consent to the personal jurisdiction of such courts and waive any objection to venue.
